Terms & Conditions
1.1. The aim of www.theparentconnection.org.uk ("the Site") is to provide an interactive, online service for parents to access information that enables them to work on and strengthen the parenting relationship both during and after separation. The purpose of the Site is to provide information and resources only. The Site does not intend to provide any other service for which it may be held liable. Please note, this is a "self-help" website; the service does not provide online counseling, legal advice neither is it a place for crisis relationship support or active intervention.
1.2. By accessing any of the pages or using any of the services or functionality provided on the Site you agree to comply with the Terms and Conditions set out below.
1.4. If you do not agree with any of these Terms and Conditions then please do not make any use of the Site and leave it immediately.
1.5. The Site is operated by and a service of OnePlusOne; the operating name of OnePlusOne Marriage and Partnership Research. OnePlusOne is a Registered Charity No. 1087994 and a private company Limited by Guarantee, registered in England and Wales, company No. 4133340 whose registered address is, CAN Mezzanine, 7-14 Great Dover Street, London SE1 4YR, United Kingdom.
1.6. References to "we", "us" and "our" throughout this document should be read as references to OnePlusOne.
1.7. When you register on the Site, you agree to receive Newsletters and unsolicited emails, from us by email from time to time. To make sure we are continually offering a useful service we will regularly carry out evaluation with a sample of users registered on the site. Occasionally we may contact you by email to ask if you would be willing to participate in any such evaluation, however you are under no obligation to do so. If you do not wish to receive future emails, you may unsubscribe from the mailing by following the instructions given at the bottom of any such email, or by ticking ‘unsubscribe to the newsletter’ within the privacy settings in your personal profile area, created during registration.
1.8. We have taken care to ensure the Site is as technically robust as possible. However, as certain technical matters may be beyond our control, we cannot guarantee that you will have uninterrupted access to the Site at all times.
2. Use of Content
2.1. All copyright and all other intellectual property rights (including, but not limited to, copyright) in all text, images, sound, software, service marks, logos and other materials on the pages of the Site ("the Content") are owned by OnePlusOne, or are reproduced on the Site with permission of the relevant rights owner.
2.2. The Content may not be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form nor by any means without OnePlusOne's express prior written consent, except as stated at clauses 2.3 and 2.4 below.
2.3. You may read, view, print, download and (where appropriate) listen to the Content of an individual page for private and personal non-commercial use only provided that all copyright, trade mark and other proprietary notices contained in the original Content on any copy of such Content is retained. You may make more copies electronically or otherwise of any of the Content for your personal use, but you may not re-copy or further distribute, sell, publish or transmit any part of the Content by electronic or any other means.
2.4. If you are a professional who works with families as part of your job then you may access, view and print Content from the Site and freely distribute to your clients providing you acknowledge copyright of the material and its source. You must not charge for any Content from the Site you distribute.
2.5. You agree not to sell, resell, supply or otherwise make the Content or extracts or other information derived there from available in any manner or on any media whatsoever to any third party without the express prior written consent of OnePlusOne.
2.6. The names, images and logos identifying OnePlusOne, its projects, products and services (including, but not limited to, the name and logo of "www.theparentconnection.org.uk") , or those of third parties, are the proprietary marks of OnePlusOne, and/or may be the proprietary marks of third parties. Any use made of these marks may be an infringement of rights in those marks and OnePlusOne reserves all rights to enforce such rights that it might have.
3. Prohibited Use
3.1. You agree not to use the Site, including commenting on the forum and on content, to:
3.1.1. post, upload, e-mail or otherwise transmit any material, the publication, dissemination, use or possession of which infringes the rights of any person or which is unlawful in any other respect;
3.1.2. contribute or use in any manner which could damage, disable, overburden, or impair the Site;
3.1.3. make available personal identifiable data about any person including yourself, or to collect or store personal data about other users;
3.1.4. obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site;
3.1.5. impersonate any other person or entity (including, but not limited to, a member of One Plus One or anyone authorized to act on their behalf), or to provide false or inaccurate information;
3.1.6. act, communicate or make a contribution to the Site in any way which is threatening, harmful, abusive, vulgar, racist, sexist, ageist or otherwise discriminatory, defamatory, sexually orientated, hateful, invasive of another's privacy or obscene, or which will (or potentially will) harass, distress, embarrass or inconvenience or be objectionable to any person or which might restrict or inhibit the use and enjoyment of the Site by any person;
3.1.7. post, upload, e-mail or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation or commercial exploitation;
3.1.8. post, upload, e-mail or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, restrict, destroy, limit the functionality of or compromise the integrity of any computer software or hardware or telecommunications equipment;
3.1.9. disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users' ability to engage in effective usage of the Site;
3.1.10. create a database (electronic or otherwise) that includes any Content, including, but not limited to, User Generated Content, held on the Site;
3.1.11. use the Site in any way whatsoever to solicit information from other users for any media or marketing activities, or;
3.1.12. contribute to the Site in any way which may bring OnePlusOne into disrepute
4. Posting and commenting on the forum and content on the site
4.1. Your use of and participation on the Site is expressly subject to these Terms & Conditions and any other guidance, instructions or rules that we may make available on the Site related to acceptable usage of the comments functionality .
4.2. You acknowledge that you are entirely responsible for all material that you upload or post on the forum or anywhere on the Site and any consequences that arise from it.
4.3. You must not enter any personal identifiable information on the Site including, but not limited to, surnames, address details, dates of birth, telephone/mobile numbers and email addresses. Any comments including such information entered on the forum or anywhere else on the Site will be subject to editing and removal.
4.4. You must enter all comments in English. Any comments not written in English will be subject to editing and removal.
4.5. You acknowledge that OnePlusOne does not pre-screen, edit or monitor the content entered by users but that we (and those authorised by us) have the right (but not the obligation), in our sole discretion and without prior warning or notice, to refuse or remove any material that is entered onto the Site.
4.6. Furthermore, you acknowledge and accept that at our sole discretion, we have the right to close or suspend a user's access to the Site without question or obligation to enter into further discussion on the matter.
4.7. Without limiting the foregoing, OnePlusOne and its designees shall have the right to remove any material that is contrary to these Terms and Conditions or is otherwise objectionable, by reference to these Terms and Conditions
4.8. You further acknowledge that Comments and Listening Room functionality provided on www.theparentconnection.org.uk by OnePlusOne is not a place to seek or receive counseling, crisis support or intervention.
4.9. You must not promote or advertise commercial companies, products or services on the Site; neither must you send chain, junk, spam or any bulk mail of any kind.
4.10. Journalists, reporters or anyone involved working in the media must not use the Site to gain access to individuals for information of any kind. Separate information for detailing how the Site can be of benefit to the media is available on the Media Relations page (see footer on the Site).
4.11. If you are concerned about material posted on the forum or anywhere else on the Site, or become aware that any material or any activities carried out there are offensive, unlawful, or contrary to these Terms & Conditions or infringe any third party rights in any way, please either flag the comment accordingly using the functionality provided or notify us by completing the contact form on the contact us page
4.12. Any such flagged material or emails received will be processed by us within 24 hours of receiving such notification. We will remove any such material or we will use reasonable endeavours to otherwise deal with the concern, however we see fit in our sole discretion. OnePlusOne will not be held liable for any harm, offence or emotional distress caused during this time.
4.13. You acknowledge and agree that we are not obliged to enter into any discussion following the removal of any material from the Site, or any other action we may take under or with reference to these Terms and Conditions.
4.14. You acknowledge and understand that any views expressed in comments generated by users on the forum or anywhere else on the site are not the views of, and do not necessarily reflect the views of, and are not endorsed, by OnePlusOne. These views cannot therefore be attributed to OnePlusOne.
5. Use of User Generated Content
5.3. By submitting any messages, suggestions or material to the Site you waive all of the moral rights that you may have under Chapter IV of the Copyright, Design and Patents Act 1988 in respect of any such message, suggestion or material.
5.4. You acknowledge that OnePlusOne may establish general practices and limits concerning the use of the Site, including (but not limited to) the maximum number of days that material on the Site, will be retained by the Site. You agree that we have no liability for the deletion or failure to store any messages, suggestions, material or other communications maintained on or transmitted to the Site
5.5. If you do not wish to grant OnePlusOne the rights set out above, do not submit contributions to the Site
6. Warranties and Liability
6.1. Your use of the Site is at your sole risk. The Content has been included in good faith, is only for your general information, and is for non-commercial use. In particular, the Content does not constitute any form of advice, recommendation or arrangement by One Plus One and is not intended to be relied upon by users in making (or refraining from making) any specific decisions or to be a substitute for obtaining professional advice. YOU ARE RESPONSIBLE FOR CHECKING THE ACCURACY OF RELEVANT FACTS AND OPINIONS GIVEN ON THE SITE BEFORE ENTERING INTO ANY COMMITMENT OR TAKING ANY OTHER FORM OF ACTION OR INACTION BASED UPON THEM. ONE PLUS ONE DOES NOT REPRESENT OR GUARANTEE THE TRUTHFULNESS, ACCURACY OR RELIABILITY OF POSTINGS SUBMITTED BY USERS ON THE SITE, OR ENDORSE ANY OPINIONS EXPRESSED BY USERS. ONE PLUS ONE WILL NOT BE HELD LIABLE FOR ANY OFFENCE, HARM,EMOTIONAL DISTRESS OR LOSS THAT OCCURS AS A RESULT OF THE USE OR VIEWING OF THIS WEBSITE. All conditions, warranties, terms and undertakings express or implied statutory or otherwise in respect of the provision of the Content and the Site are excluded to the fullest extent permitted by law.
6.2. We will take every effort to ensure that the Content on the site is accurate, however we cannot be held liable for any inaccuracies or typographical errors identified. Also, whilst we will ensure best practice is followed for ensuring the technical integrity of the Site we cannot warrant its availability or that it will be free of viruses or other harmful components.
6.3. The Site contains links to other websites ("Third Party Sites"). We neither endorse nor take responsibility for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites. If you decide to use these links to access Third Party Sites you do so entirely at your own risk.
6.4. Save as expressly provided for in these Terms and Conditions, we shall not be liable in any jurisdiction for any direct, indirect or consequential loss or damage (including, without limit, loss of property or profit, business revenue or opportunity or anticipated savings and loss of or damage to any data) or for any costs, claims or demands of any nature whatsoever arising directly or indirectly out of the use of or access to the Site, Content or any part thereof or in respect of any defect therein or any failure to provide or the late delivery of the same howsoever arising.
6.5. You agree to indemnify and hold OnePlusOne and its officers, employees and agents harmless from any claim or demand made by any third party due to or arising from your use of the Site (including, but not limited, your use of the Forum).
7.2. If we deem it necessary or appropriate under our moral duty of care to individuals and others using the Site to disclose your user identity details, along with any other data held, to the courts or other law enforcement authorities and/or agencies we will do so.

8. Breach of the Terms and Conditions
8.1. We will be entitled to restrict, suspend or terminate your membership or deny you access to the Site or take such other action as we deem appropriate if we determine, in our sole discretion, that you are in breach any of the Terms and Conditions or that your use of the Site is inappropriate or otherwise unacceptable.
8.2. The restriction, suspension or termination of our service pursuant to this section will be without prejudice to any rights that we may have against you in respect of your breach of these Terms and Conditions.
9. Changes to these Terms and Conditions, and amendments to the Site
9.1. We reserve the right, at our discretion, to make changes to any part of the Site, including, but not limited to content and user generated content on the Site, for whatever reason we deem necessary and at our sole discretion.
9.2. Due to our policy of updating and improving the Site, we may wish to change these Terms and Conditions from time to time and you agree to be bound by the Terms and Conditions, which apply at the time of your use of the Site.
10. Governing Law and Jurisdiction
10.1. These Terms and Conditions shall be governed by, and construed in accordance with, English law and you and One Plus One irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute, which may arise out of, under, or in connection with the same or the legal relationship established by them.
10.2. Any advice or guidance given on the Site cannot be deemed valid outside of England. Users accessing the Site from outside of England should take legal and professional advice in the jurisdiction in which they reside.
11. Information about cookies on the Parent Connection
Managing cookie settings
If you don't want to receive certain categories of cookies on the parent connection website, you can opt-out of them by changing your cookie settings via your browser; your browser help function will tell you how.. We will need to set a cookie so that we can remember your choices when you next visit the website from the same browser.
Note: The ParentConnection will work without cookies, but you will not be able to log in to use some of the features and functionality if you choose to disable cookies. For example, you won't be able to post on the forum or use the live chat function 'the listening room'.
We don’t sell the information collected by cookies, nor do we disclose the information to third parties, except where required by law (for example to government bodies and law enforcement agencies).
12.1. If any provision of these terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
12.2. Failure by either party to exercise any right or remedy under these terms does not constitute a waiver of that right or remedy. Headings in these terms are for convenience only and will have no legal meaning or effect.
