New guidance for divorcing couples

The Ministry of Justice has published new guidance to support divorcing couples in understanding the court process and the decisions that may be made about their finances.

The new guidance, which is available to download for free, is designed to help couples understand a judge’s decisions over their financial future. It also gives information on out-of-court settlements and how to reach these fairly.

The guide also gives an overview of the laws regarding child maintenance, housing, and pensions, to help separating couples make sense of the things that are likely to come up in court.

The guidance aims to use plain English to:

  • provide information on financial settlements for couples leaving a marriage or civil partnership
  • explain how judges reach decisions about financial settlements, and
  • help people understand the whole process, to give them a better chance of reaching a fairer settlement.

It is hoped that the guide will be of value to the increasing number of people representing themselves in court in divorce proceedings.
